After the judgment of the Osaka District Court on February 21, 2013, we received an inquiry from a user of Kawata Mfg. Co., Ltd. 's fluidized hopper equipment.

This judgment ordered the defendant Kawata to stop manufacturing and selling the fluidized hopper equipment shown in the drawing below, to dispose of the products in stock, and to compensate for damages. The user's inquiry was concerned that continued use of this fluid hopper device would constitute a patent infringement.

As a result of considering such inquiries, to avoid placing an excessive burden on users who have purchased from Kawata Co., Ltd. by March 1, 2013, the relevant flow hopper If you wish to continue using the device, please apply in the following manner and we will grant you a free license.
According to the Osaka District Court ruling, Kawata Corporation is prohibited from manufacturing and selling the fluidized hopper device (with provisional execution declaration). (including mixing wood with recycled materials) is found to be infringing. In this regard, the court determined that if the user uses the fluidized hopper device only to remove fine powder from a single material, it does not constitute an infringement of our patent. However, since this issue affects the amount of damages to Kawata, we have filed an appeal, and the Intellectual Property High Court will recognize this usage as an infringement and will fight to calculate damages. .
